•       You will not share, forward, or re-post any content from this Site in a manner accessible to minors;

Product availability on the Site is subject to change without notice. We reserve the right to discontinue any product at any time. All orders are subject to acceptance and availability.

Prices for products are subject to change without notice. We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of any product or service.

4.3 Age-Restricted Shipping

All orders containing alcoholic beverages require an adult signature upon delivery. By placing an order, you agree to provide valid government-issued identification verifying your age at the time of delivery. Orders may not be left unattended. We comply with all applicable laws governing the sale and shipment of alcohol, including state-by-state restrictions. We do not ship to jurisdictions where the shipment of alcohol is prohibited by law.

4.4 Returns & Refunds

Due to the nature of alcoholic beverage products and applicable regulations, all sales are final unless the product is defective or damaged upon delivery. If you receive a damaged or defective product, please contact us within 7 days of receipt at the contact information provided below.

The Site and its entire contents, features, and functionality—including but not limited to text, graphics, logos, icons, images, audio clips, and software—are owned by Mur Mur Rum, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

The MUR MUR RUM name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Mur Mur Rum. You may not use such marks without our prior written permission.

If you submit, post, or transmit any content to the Site (including reviews, comments, or social media interactions tagged with our brand), you grant MUR MUR RUM a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content worldwide in any media. You represent and warrant that you own or have the rights to all content you submit, and that your content does not infringe the rights of any third party.

TO THE FULLEST EXTENT PERMITTED BY LAW, MUR MUR RUM, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, AND DIRECTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SITE OR ANY CONTENT THEREON.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100.00).

You agree to defend, indemnify, and hold harmless MUR MUR RUM and its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site.

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Texas, and you consent to personal jurisdiction in such courts.

Before initiating any legal proceeding, you agree to provide written notice to us describing the nature of the dispute and your desired resolution, and to attempt in good faith to resolve the dispute informally for a period of thirty (30) days.
